Protecting Abortion Access in Michigan
The Supreme Court announced that they will hear a case during their 2021 session which will directly challenge its decision in Roe v. Wade. Should Roe be overturned or further eroded, abortion will become illegal in Michigan. This is because Michigan is one of 10 states with pre-Roe laws that ban abortion still on the books.
The law, Act 328 of 1931, criminalizes abortion as manslaughter and states that providers who carry out abortions shall be guilty of a felony, except when necessary to save the life of a pregnant person.
Sen. Erika Geiss (D-Taylor) has introduced a bill (titled SB 70) to repeal the 1931 law, but it must first pass in Michigan’s Republican controlled Senate.
