ILLEGAL TOXIC & HAZARDOUS MATERIAL & DEBRIS GARBAGE PIT ON MY RENTED PROPERTY!
(this is a long story, I am sorry, but you need to know the details & the TRUTH so hopefully you can HELP me get a lawyer?)
My family & I are in need of your help. I rent a 2 acre property in Ellicott, 80808. We have lived on this lot since late 2015, after I bought our mobile home. At the time I bought our home, & signed the lease in late 2015, there was & still IS a huge covered up illegal garbage pit. The old landlord who we signed lease with sold this mobile home park to new owners a little after that time. Before the new owners bought it, they were supposed to dig out & get rid of ALL that garbage. They did NOT do that. Instead it was simply covered up.
I complained about it all these years since they bought this mobile home park because the fact it was & still IS a serious threat safety hazard to us or our animals or god forbid any children. We have lived being deprived the use of our rented property for safe & happy use as is our legal right. The landlords would always say to me I am just trying to create waves & I should simply continue to ignore the issue & leave them alone about it. yet according to the lease, it was & is my responsibility to maintain the property, I.E. mowing the grass.
Now mind you, these actions over the years by me attempting to get them to do the right thing & clean it out, so we can safely use our rented property, they have caused me intimidation, harassment, name callings, retaliatory actions in trying to make us to want to move out.
In March of 2020, while doing my duties as spoken in the lease, I.E. mowing the grass, The toxic & hazardous material & debris garbage pit collapsed in a cavity pulling me inside it, forcing me to do a full split & completely taking in my leg all the way to my privates soldier there. It was fast & painful as I heard a snap & felt a pop. I was stuck in the hole until over an hour later my wife who has multiple sclerosis came out to look for me & found me trapped & in pain inside the collapsed cavity that swallowed me in. The paramedic & police were called & they had to literally dig me out of the caved in cavity. I had x-rays taken & it shown my L1 was fractured & following tests shows I have nerve damage, which I am going to need to have an operation for to try to fix & alleviate my pain in my back & numbness in my leg & other issues stemming from that.
I had reached out to El Paso County Code Enforcement about this pit. 2 months prior to this, I admit, I screwed up & committed a crime RE: MMJ. The landlords FINALLY had something to use against me legally to evict us out of the park, since we never left prior to this through their continued harassment & intimidation etc to my family over that CURSED PIT!!! In their minds, it is far easier to easily be able to get rid of us out of this park, & far cheaper, than it would be to dig up & to remove that cursed Pit & make this property safe for myself & my family, & now especially, for anyone else who will live here after they evict us. Their continued cover up of their criminal pit that was ordered of them to be dug out & all removed years previously, will still be COVERED UP! In more ways than one.
So anyways code enforcement came out & found this is in violation & that the landlords needed to come out to my rented property, & dig out this pit & clean out/remove all the buried trash & material & debris that is toxic as well as unsafe garbage & harmful to environment. They NOT done so.
Instead, they criminally trespassed onto my rented property, with a bobcat bulldozer through my fence, & under the pretense of complying to Code Enforcement demands, they instead only stay in my rented property for 5 minutes NOT to dig or clean, but to literally COVER UP the collapsed in hole that broke my back! Then they left. They told code enforcement that they complied & dug the pit up & threw away all the trash. THEY LIED!! i CALLED THE POLICE & THE PARK MANAGER & HER HUSBAND, WERE CHARGED WITH 3RD DEGREE MISD> for criminal trespassing onto my rented property.
ANYWAYS,.. Code enforcement did NOT do anything about it. At that time in March of 2020, I also reached out to the Mobile Home Park Oversight Program. because tenants have rights, as so does the landlord's. But they help uphold those rights & ensure laws to be followed that abound for mobile home parks in Colorado. They as well, have asked the landlord's to dig up & clean out this hazardous material & debris toxic garbage pit. The landlords pulled the same lie telling them as they told the El Paso Code Enforcement that they did dig up & clean out all the garbage. However there was & is a problem,... I took video of their CRIME in breaking onto my rented property & showing nothing was done but to cover up the collapsed in cavoty/hole that caused me serious harm.
The landlord's a day after my accident, emailed me only to NOT ask if I am ok, or how I am, but NO!! Instead they tell me they heard from park manager about it & also put blame on the previous landlord who was responsible for it. Disassociating themselves from responsibility for what they KNOWINGLY KNEW WAS THERE & COVERED UP, feigning ignorance that they were not aware of it.
I was so damm PISSSSSSED OFF! Anyway, so after they criminally trespassed on my rented property to cover up what happened to me, AS IF,... The code enforcement people told me they had NO proof that they did NOT dig up & clean out that pit that broke my back. I shown them as I posed here, Google Earth images that show the pit in late 2015. & also one from 2019. You can easily SEE where the covered pit is sinking/collapsing IN on itself over the past few years. Code enforcement stated to me that was not enough evidence. So they said I myself, had to remove the surface soil material, to show garbage & debris being covered up. That they NOT had or have the means or ability to find out themselves. I again, was so PISSSSED OFF!
SO,..... i HAD to pay a few friends,... NOT THE LANDLORD'S, to literally come out here & with shovels, to dig up that evidence to show the code enforcement that there is indeed alot of garbage being covered up.
So once we did that, & I have videos & pics to show that was done as well. Since code enforcement likes others to do their work for them, so I took vids & pics. :-)
Anyways, code enforcement then seen the evidence & must have spoken to the landlord's because all of a sudden, I get a call in June of 2020, a call from the landlord's themselves, wanting to all of a sudden make peace, & forget about this, & they will drop my eviction case (details of that for another yet long post but related.. stay tuned?)
I of course said yes, as this caused us, really THEY caused us enough harm & SERIOUS EMOTIONAL DISTRESS, that we simply said YES. LET'S HAVE PEACE. I just had to not follow up anymore with the garbage pit issue, as the landlord mentioned a couple times something about a heavy fine? I only attribute that to what I feel must have been through the code enforcement people after I shown our evidences.
He said they would fix the pit we can keep living here in peace, he will make the park manager stop her harassing & intimidations etc. (I also have that recording of the call)!
ALL was nice since then, no issues, quiet & peaceful for us, & what seemed for a bit, even some normal civility. Until, April 23rd!! WHEN THEY SLAPPED UPON OUR DOOR A NOTICE TO QUIT! They were wanting & trying to evict us again. I started to think to myself, last year when we made this peace agreement & he supposedly dropped the eviction, that there already was in place at that same time, a NO EVICTION ORDER set in place because of the COVID-19! The case was dismissed, the landlords thinking to me was because of our agreement we had on phone (again, recorded call)! But I KNEW the real reason, was because NO EVICTIONS were taking place. They thought & still think I am stupid. They treat people in here as if we are low life peasants as they life high near Aspen noses in the air above all others type of attitudes.
ANYWAYS,... So once again, I call code enforcement administrator MINDY MADDEN, who was who I dealt with last year, & I asked her a few simple questions. One which was WHY did I never hear back from her about the garbage pit case? Mindy told me she had closed the case last year. I asked WHY? She told me it was because it was her understanding, that the landlords & I came to an agreement. BAMMMMM!!!
I said OHHH REALLY? I guess that not warrants me knowing any details from her at that time from her? She not said anything. I the n said,.. WELL, THEY RENEGGED ON THE AGREEMENT! To which she said she was reopening the case?????? REOPENING THE CASE BECAUSE THEY RENEGGED ON AN AGREEMENT BETWEEN THE LANLORD'S & MYSELF LAST YEAR??? Puzzling situation here Watson!
So she told me on the phone at that point after saying she is reopening the case again, that she will send someone out, BUT YET AGAIN,.. I WOULD HAVE TO PAY & DO THE WORK TO HAVE THE SURFACE ,MATERIAL EXPOSED TO REVEAL TRASH UNDERNEATH THAT IS COVERED UP!
So I did this, this time paying someone with a bulldozer tractor. I paid $850.00 of which we could not afford to pay, but we paid, to come out here & expose a swath across the covered up pit. We revealed trash & debris. But a lot of dirt had to be moved away 1st. The pit is in fact pretty deep & covered with a couple to few feet of surface soil covering it all up. So we exposed a swath of this pit to expose trash & debris along the way. My excavator was getting worried about his tractor getting broken as it is not a big back hoe or something that will be needed to really dig & uncover this pit. So again, I took video & images of the excavating work.
While we were excavating what code enforcement asked me to do, the park manager freaked out. Staring at us from her back yard, only 2 mobile homes away from me, was standing outside funing & on the phone. The POLICE SHOW UP! (i TOOK VIDEO OF THIS AS WELL WHEN THEY CAME OVER TO SPEAK TO ME).
iT SEEMS THE PARK MANAGER was TRYING to use the police as a weapon against me to try to have me arrested for trespassing on MY OWN RENTED PROPERTY!!! Yes you read that correctly! But I was able to counter by showing them my lease, & other documents including the pit images I shown here in this post. I also slam dunked witha counter stating to the police that the previous year, the landlord's park managers were charged with 3rd degree mid's for criminal trespassing. The police looked surprised & I said OHHHH,... FAILED TO MENTION THAT TO YA DID THEY??
Then the police went to speak to them & simply went away. Again.,.. I WAS SERIOUSLY PISSED OFF!! Talk about outrageous behaviors!
So after that, I called Mindy Madden the administrator of El Paso County Code Enforcement & let her know that once again,... I paid to have the garbage uncovered to prove again, that there was covered up trash under that soil. So Mindy set a date to send another code enforcement guy out here, a Charles Carlisle, & I made sure my excavator was here in order to hear what the code enforcement guy was going to say. If we still needed to remove surface soil, or if it was good enough to determine that the landlords were STILL IN VIOLATION. Charles stated that we not had to dig anymore, & that enough was showing that this pit is still in violation. he told me he was going to send the landlords a 2 week notice to dig up & clean out the garbage pit OR... That they will be put in violation. So we waited & waited for the 2 weeks to go by. When the time was almost passed, 2 days before it was to pass, we get a notice from the park manager for a NOTICE OF INTENT TO ENTER! Statiing the dates from May 28th-June 3rd 2021, that dump trucks, workers, semi trailers, back hoes etc would be brought through the front of my rented property, to pass through our rented property & go to the back property that is part of my rented property that has the hazardous covered up garbage pit.
I call this effort THE PIT CLEAN-OUT PROJECT JOKE. (seems I was correct in that naming).
I even argued with her stating that if anything was too large to fit through my 11 ft wide gates in the front & mid section of my rented property, then she must find another way inside. I told her to use the side of the yard she trespassed through last year to get to the garbage pit area of my rented property. I was told by park manager that she could not because that would be trespassing & that they had to go through my full rented property entering from the front. I said again OK, BUT ONLY IF IT FITS AS YOU WILL NOT DISMANTLE OR DESTROY MY PROPERTY. She snapped at me saying WHAT IS YOUR PROPERTY with a laugh. I said my fencing, gates etc. We have 13 emotional support dogs & dismantling or destroying our fencing property that we own, will only llow them to be able to escape my yard & cause problems. She said not to worry.
So when May 28th came, she showed up with only 2 other people. A park asst manager who is not in good health & the park managers son in a golf cart with a tiny trailer. NO BACK HOES, NO DUMP TRUCKS, NO SEMI TRAILERS... NO WORKERS ETC. Just those 3. So I took video for each day they were here to do work. It was also only 3 days they did work, with a total of about 5 & a half hours total worked over those 3 days of work.

Again, WHAT A JOKE! No dump trucks, no workers, no semi's, no back hoes... NOTHING! Just these few. On the 2nd day, they deliberately park their vehicle in front of the camera so we could not see what they were doing, which was not much, just cleaning & COVERING UP TRASH AGAIN. On the last day she brings a neighbor with his bobcat skid loader & after them only cleaning the garbage that we excavated for code enforcement to see a violation was still there, they used him to simply cover up all that we excavated for code enforcement. I stood out there the entire time for that video & speak to you all about what is going on & how to interpret something that not needs interpreting that the landlords had no intentions of using any of the things stated to me in the notice of intent to enter to do this PROJECT.
AGAIN,...I AM VERY PISSSSED OFF!!
So as they were leaving after smoothing over the covered up garbage pit, & the park manager taking an image of their false progress to claim to code enforcement that they were compliant in digging up & cleaning out that garbage pit, she got in her truck & was leaving through my yard when I stopped her to ask her is she was done. I asked her ARE YOU DONE? She said yes for that day. I then asked the obvious, ARE YOU COMING BACK AGAIN LATER OR TOMORROW TO DIG UP & CLEAN OUT THAT GARBAGE PIT? BECAUSE THE LANDLORD'S WERE TOLD THEY MUST DIG UP & REMOVE ALL THAT GARBAGE! Her answer was shocking but not sosurprising?! She said... I DON'T KNOW! Isaid YOU DON'T KNOW??? Then she said there ws still afew days left according to the paperwork notice we were given, I reiterated that final date was June 3rd. She said she knows & she will get back to me. SHE NEVER GOT BACK TO ME.
Now one may be wondering another obvious question, WHY WOULD CODE ENFORCEMENT NOT BE ON TOP OF THE BALL DOING THEIR JOB ON THIS? That I had to pay to have my rented property of the land;lod's negligence & criminal garbage pit that can have the landlord's be prosecuted I was told, NOT make the landlord's expose & clean out that pit UNDER CODE ENFORCEMENT SUPERVISION??
Well great question. But before I tell you all that answer, let me also fill you all in on a little secret.. The park Manager's husband who was also charged last year for trespassing on my rented property, IS A HIGH HONCHO AT THE REGIONAL BUILDING WHERE CODE ENFORCEMENT IS!!!!! I remember the park manager & he himself mentioning that boasting about it in the past. It is the only thing that itches in my mind of possibilities here.
Also needed to know here is that when Charles Carlisle was sent out here to speak to myself & my excavator, the notice he said he was going to send to the landlord's? WAS SENT TO ME LABELLING ME.... AS THE ALLEGED VIOLATOR!!
(I also have the phone calls I made to Charles Carlisle & Mindy Madden about that), with them sounding like they were trying to figure out an excuse & what to say & trying to explain the how & why I was labelled as THE ALLEGED VIOLATOR!!!

I called them & asked them how many times must I pay to remove the surface to show what is underneathm while the landlords pay nothing themselves to do what is their responsibilty to do to begin with & NOT WANT TO DO! I then asked AT WHAT POINT IS CODE ENFORCEMENT COMPLICIT IN THE LANDLORD'S CRIMINAL ATTEMPTS TO CONTINUE COVERING UP THIS CRIMINAL PIT AT MY EXPENSE????!!!!!
No answer... YET!!! I will be recording that tomorrow!! I spoken with Charles Carlisle today, June 1st & he is saying something else altogether, that he said to me & Mindy madden said to me a couple weeks ago. Charles is now saying they just had to clean up what I paid for to expose & fill it back in???? THEN WHAT WAS THE POINT IN ME EXPOSING ANYTHING AT ALL IF THE CODE ENFORCEMENT WAS NOT GOING TO DO THEIR JOB? WHY DID CHARLES TELL ME & THE EXCAVATOR I HIRED A COUPLE WEEKS AGO THAT WE NOT HAD TO DIG ANYMORE UP OR REVEAL MORE AS HE SEEN ENOUGH TO SHOW THE LANDLORDS WERE & ARE IN VIOLATION. I DEMAND A COURT ORDER SOMEHOW... But in the least since code enforcement is playing this game,... I NEED YOUR HELP TO EXPOSE THE FULL BREATH OF THIS GARBAGE PIT TO REVEAL WHAT IS ALL UNDERNEATH THE SOIL & EXPOSE THE LANDLORD'S NEGLIGENCE & MAKE THEM PAY FOR THEIR CRIMINAL ACTS & NEGLIGENCE AGAINST US!!
