I'm here to raise money for an appellate lawyer to review, and hopefully modify, the conviction and sentence of someone I love.
In 2021, my husband had a mental breakdown- a true break from reality. He's been diagnosed as bi-polar, but the incident I'm trying to raise money to defend went far beyond any bi-polar symptoms that I've ever witnessed.
He was driving with his mother, and he ran into several vehicles. Witnesses alleged that it was intentional, that he meant to harm people, but that was not the case. He also stripped off all of his clothing in the middle of all of the traffic as chaos ensued. He was quite literally out of his mind, and it was proven at the hospital that his break from reality was not drug-induced. We were told initially that no charges would be filed; that turned out to be false.
He's been convicted of 6 counts of assault with a deadly weapon (the weapon being the vehicle) and sentenced to 12 years in prison. His lawyer did nothing other than the scare him into accepting this plea bargain.
My goal is to find, and be able to pay, a competent attorney who will show me how to file a Writ of Habeas Corpus correctly, or take his case for appeal based on ineffective representation, and evidence that was not submitted, as well as taking his mental state into consideration.
This man is not an angel. But he has never been charged with a violent crime; he is not violent, period. He has a family who loves him: myself, adult sons, grandchildren, (plus one on the way) and an elderly, ill mother...he does not deserve the extreme charges or the sentence he received. He deserves a fair trial at the very least.
It's a strange story, I know. This is the short version, but I'm not adverse to answering some questions, since I'm asking for funds. I REALLY don't like that I'm attempting crowdfunding for his legal defense, but when your spouse of 30 years is facing serious injustice,.and time, you do what you never thought you'd do.
