I am a 63 year-old male who is requesting assistance to pay for legal fees for a civil matter.
I was a 1099 contract employee for a Tempe based company. When I was hired the business was in desperate need of a makeover as well as update in many many other areas.
I was on a commission based compensation plan so it made a lot of sense to invest into new fixtures, equipment, computers and others tools of the trade, in order to help the business from failing and to earn a fair commission earnings.
I spent a little over 6 years in this position and left the company in June 2024.
The owner had indicated that his lease on the building was expiring in October 2023 and was going to renew a lease. He had not decided to ask landlord for a month to month type lease since he could possibly earn revenue during the winter time ( the busiest time for business) then have some type of liquidation sale.
I agreed to allow all of my equipment/tools to remain in business as he winded down the business, with full knowledge that. I owned all of this and he only had the right of use.
Moving forward I was advised in April 2024 that he decided to sell business not liquidate . Once I found this out I approached him and asked if all of my equipment/tools were going to be a party in the sale. He was advised again that I owned all of my equipment/ tools and if they were part of sale that I would have to compensated. I was told that I would be made whole on everything.
Unfortunately for me he was paid for the sale of the business but refused to settle matter.
I now have to hire an attorney, which is going to cost around $60,000 for the court matters.
I am not only out for my equipment/ tools I was also not paid for my commissions earned. The amount of money will be over $250,000.00
