On July 11, 2025, my husband, Guilherme “Gui” Silva, was ambushed and detained by ICE on San Juan Island, WA, under highly suspicious circumstances. Gui has no criminal record. We believe this was a targeted setup connected to a custody dispute. He was treated inhumanely—denied the right to see a warrant, mocked, and subjected to unsafe conditions.
I’m now 8 months pregnant, and we’re expecting our son in October. Gui’s detention has left our family without his income as we are preparing for the birth of our baby boyand facing mounting legal fees. After weeks of fighting with an Immigration Attorney, a judge granted Gui’s release on bond on July 29, since we had already filed our I-485 application for his green card. I paid my husband’s $8000 bond in full and signed his release papers. Instead of releasing him, ICE secretly transferred him to be detained elsewhere, while lying to me and making me wait 12hrs until they told me that they didn’t know where my husband was. This corruption has led us into a whole new legal battle in Washington state. Fighting for Gui’s freedom… again. We’ve now had to retain a WA state lawyer, but the costs are overwhelming.
We urgently need funds to cover attorney fees, to keep fighting this injustice. I need my husband home safe with me, I don’t want to give birth to our son without him by my side. Update: 9/2/25 We had a hearing this morning which was the cutoff date for omnibus (prosecution to get all discovery and evidence in). prosecution handed in a statement that just explains ICE searched Gui’s phone on 7/11/25, which we already knew. We do not have any pictures or proof of the charges. Only allegations to San Juan Sheriff from Gui’s ex-wife Kayla Van Skyhawk, which were unfounded and case was closed. Kayla, hoping for a different outcome then proceeded to take Zahara off island, for a traumatizing investigation, abuse allegations were unfounded and the case closed. Realizing she wasn’t going to get her way with the investigation, Kayla Van Skyhawk then abused a broken immigration system and called to report my husband to ICE. This all began the week after Gui & I told Zahara that she was going to have a little brother & Kayla found out we had retained a custody lawyer. Zahara has been exposed to so much trauma at the hand of her own mother. Our attorney requested for the original warrant for ICE arrest and body cam footage from ICE agents, which are not being handed over. Prosecution has nothing. We have been in front of 3/5 of the judges in Bellingham with no resolution, and each judge just keeps pushing the case to another judge, delaying detainment. We have not been given due process or a speedy trial which has been a complete disregard of my husband’s 6th amendment rights. Both our immigration and criminal defense attorneys have said that this is the first case of this matter with this kind of corruption that they have experienced. We are now waiting for another hearing to get in front of a judge hoping, yet again, for some resolution. I am now 34 weeks pregnant, traveling from CA to WA. I’ve thrown so much money into this case already. We need your help as this case is continuing. Please share our story and spot fund if you can. My heart is broken.
